PLEASE READ AND UNDERSTAND THESE POLICIES BEFORE SUBMITTING YOUR APPLICATION TO RED RHINO TOURS
ACKNOWLEDGMENT AND ASSUMPTION OF RISK, RELEASE AND INDEMNIFICATION
In consideration of the services provided by Red Rhino Tours and Red Sweater Project, its shareholders, directors, officers, employees, agents, volunteers, participants and all other persons or entities associated with or acting in any capacity on its behalf (collectively referred to as “Red Rhino Tours”), I hereby agree to release, indemnify and discharge Red Rhino Tours, give up any claims of any kind on behalf of myself, my heirs, assigns, personal representative and estate and for all members of my family, including minor children, as follows:
1. I acknowledge that exploration, including but not limited to trekking, rock climbing, safari and mountaineering, entail known and unanticipated risks that could result in physical or emotional trauma, injury, paralysis, death or damage to myself, property and/or third-parties. Although Red Rhino Tours has taken reasonable steps to provide me with appropriate equipment and skilled guides, I understand that such risks simply cannot be eliminated without jeopardizing the essential qualities of the activity.
The risks include, but are not limited to: the hazards of traveling in uneven mountainous terrain and slips and falls; being struck by rock fall, icefall or other objects dislodged or thrown from above; the use of climbing ropes and equipment; the forces of nature, including lightning, weather changes and avalanche; the risk of falling off the rock, mountain or into a crevasse; the risk of exposure to insect bites; the propensity of any wild animal to behave in ways that may result in injury or death to persons or other animals; the dangers of travel on roads, in the bush or on safari; the risk of altitude and cold including hypothermia, frostbite, acute mountain sickness, cerebral and pulmonary edema; my own physical condition and personal limitations; and the physical exertion associated with this activity. Additional dangers may include the hazards of traveling in developing countries; accident or illness in remote places without access or limited access to emergency medical facilities; war, terrorism and other forces. I understand that this description of these risks is not complete and that other unanticipated risks may occur.
Safety is a priority at Red Rhino Tours, but it might be unaware of my or another participant’s fitness or abilities. It might misjudge the weather or other environmental conditions. It may give incomplete warnings or instructions and equipment being used might malfunction. I acknowledge that engaging in this activity may require a degree of skill and knowledge different than other activities and that I have responsibilities as a participant. I acknowledge that Red Rhino Tours has been available to more fully explain to me the nature and physical demands of this activity and the risks, hazards, and dangers associated with this activity.
2. I EXPRESSLY AGREE AND PROMISE TO ACCEPT AND ASSUME ALL OF THE RISKS EXISTING IN THIS ACTIVITY. MY PARTICIPATION IN THE ACTIVITY IS PURELY VOLUNTARY, AND I ELECT TO PARTICIPATE IN SPITE OF THE RISKS.
3. I acknowledge that Red Rhino Tours and its guides have complete authority and discretion as to the performance of activities and trips and may modify itineraries, trip plans, or cancel a trip for any reason. I acknowledge that the success of the trip depends on the cooperation of the participants with the trip guides and with each other. I therefore voluntarily submit to the authority of Red Rhino Tours and its guides for the complete duration of the trip.
4. I understand that Red Rhino Tours may contract with independent contractors to provide services on the trip or activity, including transportation, travel services and guide services. I understand that Red Rhino Tours has no control over and accepts no responsibility for the actions of any independent contractor involved in providing services on the trip/activity.
5. I HEREBY VOLUNTARILY RELEASE, FOREVER DISCHARGE AND AGREE TO INDEMNIFY AND HOLD HARMLESS RED RHINO TOURS FROM ANY AND ALL CLAIMS, DEMANDS OR CAUSES OF ACTION WHICH ARE IN ANY WAY CONNECTED WITH MY PARTICIPATION IN THIS ACTIVITY OR MY USE OF RED RHINO TOURS' EQUIPMENT OR FACILITIES, INCLUDING BUT NOT LIMITED TO ANY SUCH CLAIMS WHICH ALLEGE NEGLIGENT ACTS, RECKLESS CONDUCT, OR OMISSIONS OF RED RHINO TOURS OR ANY INDEPENDENT CONTRACTOR, AGENT, SERVICE PROVIDER OR OTHER PERSON OR ENTITY ENGAGED BY RED RHINO TOURS. I FURTHER AGREE TO HOLD HARMLESS AND INDEMNIFY RED RHINO TOURS AGAINST ALL THIRD PARTY CLAIMS, DEMANDS OR CAUSES OF ACTION BY THIRD PARTIES ARISING FROM MY PARTICIPATION IN THIS ACTIVITY OR MY USE OF RED RHINO TOURS' EQUIPMENT OR FACILITIES.
6. Should Red Rhino Tours or anyone acting on their behalf incur attorney’s fees and costs to enforce this Agreement, I agree to reimburse them for all such fees and costs.
7. INSURANCE/MEDICAL AUTHORIZATION. Red Rhino Tours is not an insurer of me. For my safety, Red Rhino Tours requires participants to carry insurance to cover any injury or damage I may suffer while participating in activities. Red Rhino Tours will set the minimum levels of insurance it requires for each activity and each participant must provide proof of insurance at this minimum level or higher prior to participation. By establishing minimum levels of required insurance, Red Rhino Tours is not warranting that this will be sufficient for each participant’s individual needs and Red Rhino Tours encourages each participant to carry insurance in excess of the minimum required. I certify that I have, or will obtain prior to participation, adequate insurance to cover any injury or damage I may cause or suffer while participating and I agree to bear the costs of such injury or damage myself that are not covered by insurance. In the event I fail to provide proof of sufficient insurance, I agree that Red Rhino Tours may disallow my participation and understand that Red Rhino Tours is not responsible for any loss or costs suffered as a result. I further certify that I am willing to assume the risk of any medical or physical condition I may have. I hereby give permission for transportation to any medical facility or hospital and I authorize the any qualified guide or medical personnel to render emergency medical care for my family or myself, the cost of which I am solely responsible. I further agree to defend, indemnify and hold harmless Red Rhino Tours against any and all third party claims against Red Rhino Tours for such transportation and emergency medical care.
8. ARBITRATION. The Parties agree that any claim or dispute between them or against any agent, employee, successor, or assign of the other, whether related to this agreement or otherwise, and
any claim or dispute related to this agreement or the relationship or duties contemplated under this contract, including the validity of this arbitration clause, shall be resolved by binding arbitration by the American Arbitration Association (or equivalent services), under the Arbitration Rules then in effect. Any award of the arbitrator(s) may be entered as a judgment in any court of competent jurisdiction
9. CHOICE OF LAW/VENUE. The laws of the State of Oregon govern this Agreement and I consent to the jurisdiction and venue of the federal and state courts located in Clackamas County, Oregon subject to the arbitration agreement above.
10. ATTORNEY FEES/COSTS. If there is a dispute between the parties relating to this Agreement, the prevailing party is entitled to recover all costs and expenses of any subsequent proceedings (including trial, appellate, and arbitration proceedings), including the attorney fees incurred therein.
11. The provisions in this Agreement shall be interpreted in such a way so as to render them valid whenever possible, and any ambiguity shall not be construed against Red Rhino Tours. If any part of this agreement is held invalid by a court or arbitrator having jurisdiction, the remainder shall continue in full force and effect.
PERSONAL HEALTH CONSIDERATIONS
1. I release Red Sweater Project, Red Rhino Tours, LLC, the State of Oregon (USA), and their agents and employees from all responsibilities and liabilities for any injuries (including death), illness, claims, damages, charges, bills, or expenses I may incur while volunteering with Red Sweater Project and living/traveling abroad. I assume full responsibility and liability for any injuries (including death), illness, claims, damages, charges, bills, or other expenses I may incur while I am abroad.
2. I will obtain a comprehensive medical and accident insurance policy (Policy) for the period that I am participating in the Red Sweater Project Volunteer Program (Program). The Policy will provide coverage for injuries and illnesses I may sustain or experience in the Program countries and those in which I will live or through which I will travel while on the Program. I certify that my Policy will adequately cover me while outside my home country (if applicable) and includes coverage for emergency evacuation and repatriation. I will provide Red Sweater Project with a copy of my insurance policy prior to traveling to the Program.
3. I have arranged, through insurance or otherwise, to pay for all of my medical expenses during my participation in the Program. I agree to pay for any immunization, services, etc. required by the countries in which I will be residing or through which I will travel, as part of the Program.
The 2019 Novel Coronavirus (COVID-19, “Coronavirus”) is a known and rapidly evolving pandemic that is affecting travel worldwide, with continued spread and impacts expected.
Volunteer is fully aware of the current global COVID-19 virus outbreak, the current travel restrictions, and inherent risks involved when choosing to travel. Volunteer is aware that it is their personal decision to travel and is doing so with full knowledge of travel recommendations, restrictions, regulations, and risks
with regards to COVID-19, as well as the possibility of future travel restrictions, and takes full responsibility for their actions with regards to traveling.
In consideration of the travel planning services provided to Volunteer and with full knowledge and acceptance of the risks associated with travel, Volunteer, on behalf of themselves, their minor children, and any personal representatives, heirs, and next of kin (hereinafter referred to as “Volunteer”) hereby releases, indemnifies, holds harmless and covenants not to sue Red Sweater Project or Red Rhino Tours, LLC (“Company”), its officers, employees, volunteers, agents, representatives, and any other person involved either directly or indirectly, from all claims, suits, expenses, attorney fees and demands of any nature (including negligence) caused by, deriving from, or associated with Volunteer’s travel. Volunteer makes these covenants, release and waivers knowingly and voluntarily. It is further understood and agreed that this COVID-19 Travel Assumption of Risk, Release and Waiver of Liability, and Indemnity Agreement is to be binding on Volunteer’s heirs and assigns and Volunteer signs it of their own free will.
Volunteer understands and confirms that Company has provided Volunteer with the best available information at the time regarding travel precautions, travel restrictions, and pandemic protection policies provided by governmental agencies of destination location that Volunteer is traveling to. However, Volunteer understands and agrees that government agencies and Travel Suppliers may not enforce or apply these travel precautions, travel restrictions, and pandemic protection policies and that some travelers may refuse to cooperate with these travel precautions, travel restrictions, and pandemic protection policies. Additionally, Volunteer understands and agrees that the COVID-19 pandemic is a rapidly changing situation and that all travel precautions, travel restrictions, and pandemic protection policies are subject to change at any time and without notice. Volunteer also understands and agrees that any and all information provided by Company is made available solely for general information purposes. Company does not warrant the accuracy, completeness, or usefulness of this information. Company disclaims all liability and responsibility arising from any reliance placed on such information. Any reliance that Volunteer places on such information is strictly at their own risk. Volunteer understands that it is their responsibility to check the latest travel information regarding the COVID-19 outbreak with the CDC (https://wwwnc.cdc.gov/travel/notices), the governmental agencies of any location that Volunteer is traveling to or through, and with all Travel Suppliers, including but not limited to: airports, airlines, hotels, tour agencies, transfer agencies and/or any other provider involved in Volunteer’s booking.
Volunteer is aware of the specific travel warnings, travel restrictions, and travel rules in place for all locations in their travel itinerary, as well as the fact that travel warnings, restrictions, and rules are in place around the world. Volunteer is also aware that future travel warnings, travel restrictions, and travel rules are likely to occur without notice. Volunteer understands and accepts the risks and consequences of these travel warnings, restrictions, and rules. Volunteer is also aware that immigration and traveling restrictions may be put in place before, during, or after traveling that may impede the ability to enter or exit travel locations or return home as planned. VOLUNTEER HEREBY RELEASES, WAIVES, DISCHARGES AND AGREES NOT SUE Company for consequences of these travel warnings, restrictions and rules, failure to enforce travel warnings, restrictions and rules, as well as travel warnings, restrictions and rules changing without notice.
Volunteer is aware that additional travel screening procedures and restrictions may take place at various travel locations, including but not limited to: airports, airlines, hotels, other methods of transport, tour agencies, transfer agencies, any provider involved in Volunteer’s booking, and/or public areas. Volunteer is aware that these restrictions may include mandatory face coverings, quarantines, temperature checks, and/or various other measures. Volunteer acknowledges and agrees that, due to the nature of travel, social distancing measures, quarantine measures, pandemic prevention measures, health precautions, and/or the usage of face masks may not always be possible. VOLUNTEER HEREBY RELEASES, WAIVES, DISCHARGES AND AGREES NOT SUE Company for consequences of these travel procedures and restrictions, failure to enforce travel procedures and/or restrictions, as well as travel procedures and restrictions changing without notice.
VOLUNTEER HEREBY RELEASES, WAIVES, DISCHARGES AND AGREES NOT SUE Company for all consequences of traveling related to COVID-19, including but not limited to: travel warnings, travel restrictions, travel rules, illness, death, property damage, financial loss, costs, penalties, fees, fines, cancellations, postponements, quarantines, health regulations and/or screenings, regardless of whether these consequences are imposed by governmental agencies of the locations to which Volunteer is traveling to, and/or any other provider involved in Volunteer’s booking. Volunteer further agrees not to institute a credit card dispute or “charge back” to Company for any of these reasons.
The undersigned acknowledges and understands that traveling may result in a higher risk of contracting COVID-19. The undersigned agrees and acknowledges that traveling may involve inherent danger and risk, including, without limitation, the risk of physical illness or injury, death, or property damage. The undersigned fully understands and appreciates both the known and potential dangers of traveling and acknowledges that traveling may, despite reasonable efforts to mitigate such dangers, result in exposure to COVID-19, which could result in quarantine requirements, serious illness, disability, and/or death. THE UNDERSIGNED HEREBY ASSUMES FULL RESPONSIBILITY FOR, AND RISK OF ILLNESS, BODILY INJURY, DEATH, OR PROPERTY DAMAGE to the undersigned due to negligence, active or passive, or otherwise while traveling.
Volunteer understands that it is their responsibility to obtain travel insurance to ensure they have coverage for all medical needs and trip cancellation. However, Volunteer is aware that travel insurance generally only covers unforeseen events. Most insurers classify COVID-19 as a 'known event' and will not cover COVID-19 related cancellations, delays, quarantines, or additional costs or fees. Most policies also have a specific clause stating they do not cover epidemics and pandemics, especially when travel warnings are in place. Additionally, concerns or fear of travel is not a covered reason for cancellation and will not be covered by travel insurance. Volunteer understands that he/she is bound by the terms of the insurance policy as it relates to Coronavirus/COVID-19. Volunteer holds Company harmless for their election to not purchase travel insurance and/or any denial of claim by travel insurer as it relates to COVID-19 or any other claim under the policy.
THE UNDERSIGNED HEREBY RELEASES, WAIVES, DISCHARGES AND AGREES NOT SUE the Company, its directors, officers, employees, volunteers and agents (“Released Parties”) from all liability to the undersigned and all personal representatives, assigns, heirs, and next of kin of the undersigned from any and all liability, claims, demands, actions, omissions, and causes of action whatsoever, directly or indirectly arising out of or related to any loss, damage, claim, or injury, including property damage, illness or death, related to COVID-19 whether caused by the negligence of the Released Parties, any third-parties, or otherwise, while traveling.
THE UNDERSIGNED HEREBY AGREES TO INDEMNIFY AND HOLD HARMLESS the Company, its directors, officers, employees, volunteers and agents (“Released Parties”) from and against any and all costs, expenses, damages, claims, lawsuits, judgments, losses, and/or liabilities (including attorney fees) arising either directly or indirectly from or related to any and all claims made by or against any of the Released Parties due to any loss, damage, or injury, including property damage, personal illness or death, related to the travel services provided by Company, whether caused by the negligence of the Released Parties, any third parties, or otherwise specifically related to COVID-19.
THE UNDERSIGNED further expressly agrees that the foregoing ASSUMPTION OF RISK, RELEASE AND WAIVER OF LIABILITY AND INDEMNITY AGREEMENT shall be governed by and construed in accordance with Oregon law, and that if any of the provisions hereof are found to be unenforceable, the remainder shall be enforced as fully as possible, and the unenforceable provision(s) shall be deemed modified to the limited extent required to permit enforcement of the Waiver of Liability as a whole.
I HAVE CAREFULLY READ AND VOLUNTARILY SIGN THIS ASSUMPTION OF RISK, RELEASE AND WAIVER OF LIABILITY, AND INDEMNITY AGREEMENT AND FURTHER AGREE THAT NO ORAL REPRESENTATIONS, STATEMENTS OR INDUCEMENT APART FROM THE FOREGOING WRITTEN AGREEMENT HAVE BEEN MADE. I AM AWARE THAT BY AGREEING TO THIS AGREEMENT I AM GIVING UP VALUABLE LEGAL RIGHTS, INCLUDING THE RIGHT TO RECOVER DAMAGES FROM THE COMPANY IN CASE OF ILLNESS, INJURY, DEATH, OR PROPERTY LOSS OR DAMAGE, INCLUDING, FOR THE AVOIDANCE OF DOUBT AND WITHOUT LIMITATION, EXPOSURE TO COVID-19 WHILE TRAVELING AND ANY ILLNESS, INJURY, OR DEATH RESULTING FROM IT. I AM FULLY INFORMED OF THE RISKS INVOLVED IN TRAVELING TO DECIDE WHETHER TO SIGN THIS DOCUMENT. I UNDERSTAND THAT THIS DOCUMENT IS A PROMISE NOT TO SUE AND A RELEASE OF AND INDEMNIFICATION FOR ALL CLAIMS.
4. I am aware of all applicable personal medical needs and, at least 90 days prior to departure, I will report in writing to Red Sweater Project any physical or mental condition that may affect my participation in the Program.
LIVING CONDITIONS AND ACCOMMODATIONS
5. I understand that any medical requirements and/or restrictions placed on my participation in the Program (including disabled persons’ access to facilities or availability of special accommodations for visually- impaired or deaf persons) are determined by the laws of the countries in which the Program is located.
6. I understand that Red Sweater Project will provide shared accommodations for volunteers participating in the Program and that Red Sweater Project reserves the right to change the housing arrangement at any time. Specific room and housing assignments are within the sole discretion of Red Sweater Project.
7. I acknowledge that Red Sweater Project is not responsible for securing or supporting accommodations and travel outside of the Program.
8. Red Sweater Project reserves the right to change the Program itinerary at any time and for any reason, with or without notice, and neither Red Sweater Project nor its co-organizers will be liable for any losses or expenses incurred due to the cancellation or change.
GENERAL TRAVEL ADVISORY
9. I understand that Red Sweater Project assumes no responsibility or liability for any losses that I may incur due to: sickness, disease, or injuries (including death); losses or damages arising from weather; public health risks; criminal activity; accidents; damage to property; delays, including delayed or changed departure or arrival times; fare changes; dishonors of hotel, airline, or vehicle rental reservations; bankruptcies of airlines or lodging facilities, transportation, or other services; missed carrier connections; strikes; acts of nature; circumstances beyond the control of Red Sweater Project; force majeure; war; quarantine; civil unrest; terrorism; or for any additional expenses incurred as a result of the above.
10. I assume full responsibility and liability for any losses that I may incur due to: sickness, disease, or injuries (including death); losses or damages arising from weather; public health risks; criminal activity; accidents; damage to property; delays, including delayed or changed departure or arrival times; fare changes; dishonors of hotel, airline, or vehicle rental reservations; bankruptcies of airlines or lodging facilities, transportation, or other services; missed carrier connections; strikes; acts of nature; circumstances beyond the control of Red Sweater Project; force majeure; war; quarantine; civil unrest; terrorism; or for any additional expenses incurred as a result of the above.
11. I assume full responsibility to cover the costs incurred due to: sickness, disease, or injuries (including death); losses or damages arising from weather; public health risks; criminal activity; accidents; damage to property; delays, including delayed or changed departure or arrival times; fare changes; dishonors of hotel, airline, or vehicle rental reservations; bankruptcies of airlines or lodging facilities, transportation, or other services; missed carrier connections; strikes; acts of nature; circumstances beyond the control of Red Sweater Project; force majeure; war; quarantine; civil unrest; terrorism; or for any additional expenses incurred as a result of the above.
12. My baggage and personal property are my responsibility, and my risk and Red Sweater Project is not responsible for the loss of or damage to my baggage and/or personal property while in transit, in residence, or in storage for the duration of the Program. I assume full responsibility and liability for any losses to my personal property.
13. I am aware of and the risks and dangers of travel to, in, and around the Program country(ies), including but not limited to the dangers to my own health and personal safety posed by the use of public transportation and/or by civil unrest, political instability, terrorism, crime, violence, and disease. I will examine the information provided by my country’s consulate and the health and disease control agency, by website or other means, for up-to-date news regarding the risks of travel to the Program country(ies) prior to my departure. I will periodically review the information provided by my country’s consulate and the health and disease control agency, by website or other means, during the Program duration.
14. By my participation in the Program, I assume knowingly and voluntarily, each of these risks and all other risks that could arise during my travel.
15. I understand that Red Sweater Project reserves the right, at its sole discretion, to cancel the Program or withdraw its support for my participation in the Program or any aspects of it prior to my departure or during the Program period, including requiring that I return to my country of origin.
RESPONSIBILITY FOR BEHAVIOR
16. I understand that each Program country has its own laws, customs and standards of acceptable conduct and behavior, including appropriate dress, manners, morals, politics, and criminal, anti-corruption and controlled substance laws. I commit to become informed of, and abide by, all laws, customs and standards of acceptable conduct and behavior of the Program and/or countries through which I will travel during the Program, by consulting with my country’s available government resources and reviewing relevant travel guides and resources.
17. I assume full responsibility and liability for any consequences resulting from violations of the local laws, customs and standards of acceptable conduct and behavior. I also understand that Red Sweater Project is not responsible for providing any assistance, legal or otherwise, in dealing with violations of local laws, customs and standards.
18. I recognize that behavior that violates the local customs, laws or standards can harm the relationship between the host country and the United States and/or my country of origin; the local community and Red Sweater Project; as well as the reputation of Red Sweater Project, the Program sponsors or co-sponsors; and my own health and safety.
19. Red Sweater Project reserves the right to withdraw my involvement in the Program, or any portion thereof, at any time if my actions or general behavior impedes Red Sweater Project’s operations and/or the rights or welfare of any person, including myself. If my conduct violates any policy or procedure of Red Sweater Project, I understand that I may be required to withdraw from the Program at the sole discretion of Red Sweater Project’s employees, agents, or representatives. In such an event, Red Sweater Project will not be liable for any losses or expenses incurred due to my early withdrawal from the Program.
20. At my own expense, I shall defend, indemnify and hold Red Sweater Project harmless (including Red Sweater Project’s directors, officers, employees, and agents) from and against any and all loss, liability, claims, suits, actions, proceedings, judgments, awards, damages and expenses (including attorney’s fees) that any or all of them may incur or suffer due to my participation in Red Sweater Project and the Program and my actions and behavior.
WITHDRAWING FROM OR DECLINING PARTICIPATION IN THE PROGRAM
21. In the event that I should decide to cancel my participation in the Program or am forced to withdraw from the Program for any reason, I assume responsibilities for all Program costs that cannot be refunded. I will pay such expenses from my own funds and will hold Red Sweater Project harmless from any obligations irrespective of the date of or reason for my cancellation or withdrawal. These costs will not be replaced or replenished.
22. I hereby acknowledge that I have read, understand, and will abide by each of the terms and conditions of this agreement. I further state that I am of legal age to accept these responsibilities.
23. It is my express intent that this agreement shall bind the members of my family, if I am alive, and my heirs or a personal representative, if I am deceased, and shall be deemed as a Release, Waiver, Discharge and Covenant Not to Sue Red Sweater Project.
24. I hereby further agree that this agreement shall be construed in accordance with the laws of the State of Oregon (USA).
25. This agreement constitutes the entire agreement, and supersedes any prior contemporaneous agreements, understandings and negotiations, regarding this subject matter. This agreement (i) may not be amended, by course of conduct or otherwise, and (ii) may not be assigned, in whole or in part, except in writing duly executed by Red Sweater Project and I.
26. If a court holds any provision of this agreement unenforceable, such unenforceability shall not affect any other provision, and this agreement shall be construed as if such a provision, to the extent of such unenforceability, had not been incorporated herein.
BY CHECKING THE BOX ON THE PREVIOUS FORM FOR THIS AGREEMENT, I ACKNOWLEDGE AND CERTIFY THAT I HAVE CAREFULLY READ THE ABOVE AND UNDERSTAND THAT THIS IS A BINDING CONTRACT THAT, AMONG OTHER THINGS, RELEASES RED RHINO TOURS AND RED SWEATER PROJECT FROM LIABILITY FOR ALL CLAIMS, CAUSES OF ACTION OR DEMANDS OF ANY KIND AND NATURE WHATSOEVER RELATED TO MY PARTICIPATION IN THIS ACTIVITY AND UNDERSTAND THAT I AM WAIVING ANY RIGHT I MAY HAVE TO BRING AN ACTION AGAINST RED RHINO TOURS AND RED SWEATER PROJECT IN A COURT OF LAW OR ANY OTHER TRIBUNAL. I FURTHER ACKNOWLEDGE THAT THE PARTIES INTEND FOR THIS WAIVER OF LIABILITY TO BE INTERPRETED AS BROAD AS POSSIBLE AND OPERATE TO THE FULLEST EXTENT PERMITTED BY LAW. I HAVE HAD SUFFICIENT OPPORTUNITY TO READ THIS ENTIRE DOCUMENT, I UNDERSTAND IT, AND I VOLUNTARILY AGREE TO BE BOUND BY ITS TERMS.
